Attorneys for an inmate on death row in Virginia are asking the U.S. Supreme Court to block his execution, which is scheduled for this evening, according to the Associated Press.
Former lawyers for 42-year-old Robert Gleason on Monday asked the 4th U.S. Circuit Court of Appeals to intervene, re-appoint them to his case, and stay his execution.
They argued the inmate, who was serving a life sentence when he killed two other inmates and threatened to kill again until his execution, was not competent to waive his appeals and if appointed, they'd order a mental health evaluation.
The 4th Circuit panel refused that request and within hours, the attorneys appealed to the U.S. Supreme Court. Gleason is set to die by electrocution at 9 p.m.
