Timeline For Silver Spring Transit Center Repairs Under Dispute

The contractor working on the much-maligned and delayed Silver Spring Transit Center says repairs now being mandated by Montgomery County can not completed until next summer at the earliest.

Just minutes before David Dise, the head of Montgomery County's division of general services, was to go before the county council to give the latest update on the center, Foulger-Pratt released a statement giving the timetable of next summer as the earliest repairs could be completed.

Dise disagreed in his remarks to council members and to the press afterward, saying many factors will determine when the work can be done. Dise believes it can be finished sooner.

"What we have and what we view in this letter... is a letter to be expected under any construction contract. It's a statement of position," he said. "It's a reservation of right, and a prelude to future negotiations over claim and dispute."

Council members tended to lean more toward Foulger-Pratt's timeline. Councilwoman Nancy Floreen noted Dise's own statement that the work, which includes use of latex-modified concrete, must be done in weather with temperatures above 40 degrees.

"This isn't going to get done by the end of the year," Floreen said. "Unless we know for certain that it's going to stay above 40 degrees until Christmas."

If Foulger-Pratt and the county can agree on anything, it's this: both sides think the other should pay for the repairs.
