A former Prince George's County corrections officer, accused of neglecting a dying inmate will have his day in federal court, nearly four years after the incident.

The victim, Ronnie White, was a 19-year-old inmate who was in custody for a hit-and-run accident that killed a Prince George's County officer.

White was found unconscious in his jail cell hanging from a sheet in 2008.

Former county corrections officer Anthony McIntosh is accused of neglecting to call for medical help immediately after finding White unconscious.

In a motions hearing held this morning in Greenbelt, a federal judge heard arguments on whether to dismiss counts that McIntosh later falsified records about the incident.

Prosecutors say the defendant saw White, but left the cell and did nothing. Defense attorneys argued that McIntosh panicked. Another guard later found White and called for help.

The prosecution said the big question in this case will be: When did the victim stop breathing?

A trial by jury is set for Jan. 8.
