D.C. Clinic Settles Lawsuit For Giving Incorrect HIV Test Results

Terry Hedgepeth filed a $20 million lawsuit against the Whitman Walker Clinic five years after a clinic worker reported Hedgepeth had tested positive for HIV. The test later turned out to be negative.

Published reports claim terms of Hedgepeth's settlement with the Clinic weren't disclosed, but the agreement was reached as both sides prepared for trial.

Although the test was negative, Hedgepeth didn't find out until he decided to look for alternative treatment in 2005. His lawyer says the misdiagnosis caused his client to develop post-traumatic stress syndrome.

A District Appeals Court recently ruled that patients given incorrect information from their doctors about a life-threatening illness are allowed to sue for emotional distress.
