Kin Yiu Cheung was driving a Sky Express bus bound for New York when it swerved off Interstate 95 about 30 miles north of Richmond, hit an embankment and overturned.

Prosecutors say Cheung admitted to police that he fell asleep at the wheel just before the crash. According to a document obtained by The Associated Press, Cheung's attorneys are now asking a judge to suppress those statements. They claim he was denied access to counsel and was not advised of his rights before talking to police.
