ACLU Warns University Presidents About Advice From Attorney General

The American Civil Liberties Union of Virginia is warning public university presidents about controversial instructions from the state's attorney general.

Attorney General Kenneth Cuccinelli sent a letter to public university presidents advising them to rescind policies prohibiting discrimination on the basis of sexual orientation. Cuccinelli says only the general assembly can determine which classes of people are protected by state nondiscrimination policies, and legislators in Virginia have not banned discrimination against gays and lesbians.

The ACLU is sending its own letters to public university presidents warning them not to allow such discrimination. The group's director says U.S. Supreme Court decisions have established that governmental entities can't discriminate based on sexual orientation.

Virginia Democrats are also condemning Cuccinelli's move.
